On Sept. 23, 2022, the FMCSA published an advance notice of proposed rulemaking (ANPRM) and requested comments on whether it should amend the Federal Motor Carrier Safety Regulations (FMCSRs) to require every commercial motor vehicle (CMV) operating in interstate commerce to be equipped with electronic identification (ID). This electronic ID would be capable of wirelessly communicating a unique ID number when queried by federal or state motor carrier safety enforcement personnel.
The FMCSA states it believes the amendment to the FMCSRs will improve the efficiency and effectiveness of the roadside inspection program by more fully enabling enforcement agencies to focus their efforts on high-risk carriers and drivers. Comments on this notification must be received on or by Nov. 22, 2022.
Electronic ID Overview
Currently, the FMCSA does not require CMVs to be equipped with a system capable of transmitting a unique electronic ID for operation. These electronic ID technologies could provide a means of identifying CMVs that are either parked or in motion. Some technologies are also capable of two-way communication of information. Currently, the technologies in use for identifying CMVs operating in the United States and its territories include license plate readers and wireless mobile data services. They are used to assist businesses in tracking their inventory and operations. In addition, they also assist state and local agencies in roadside enforcement activities.
Employer Next Steps
Employers that would be affected by this change in the FMCSRs should consider commenting on the various aspects of electronic ID, including the best possible technical and operational concepts, along with associated costs, benefits, security, vulnerability, privacy and other relevant deployment and operational implications. The comment period is open until Nov. 22, 2022.
